    Digital Millennium Copyright Act — Notice and Takedown Procedures

    Introduction

    Although Flightsim.to is not subject to United States law, we do respect the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to claims of copyright infringement committed using our platform. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on our platform, please follow the procedures outlined below.

    Filing a DMCA Takedown Notice

    To file a notice of copyright infringement, you must provide a written communication that includes the following information:

    1. Identification of the copyrighted work — A description of the copyrighted work that you claim has been infringed, or if multiple works are covered by a single notification, a representative list of such works.
    2. Identification of the infringing material — A description of the material that you claim is infringing and that you want removed or access to which you want disabled, including the URL or other specific location on our platform where the material can be found.
    3. Your contact information — Your name, address, telephone number, and email address so that we can contact you regarding your complaint.
    4. Statement of good faith — A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
    5. Statement of accuracy — A statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of the copyright that is allegedly infringed.
    6. Signature — A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

    Sending Your Complaint

    Please send your DMCA takedown notice to the designated address below. For faster processing, we recommend using e-mail delivery. If you must send your notice by physical mail, you can do that too, but it will take substantially longer for us to receive and respond to it.

    Counter-Notification

    If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification with the following information:

    1. Identification of removed material — A description of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access was disabled.
    2. Statement under penalty of perjury — A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
    3. Your contact information — Your name, address, and telephone number.
    4. Consent to jurisdiction — A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which we may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
    5. Signature — A physical or electronic signature.

    Upon receiving a valid counter-notification, we will forward it to the original complainant. If the original complainant does not file a court action within 10–14 business days, we may restore the removed content. Please note that we exercise little discretion in this process other than determining whether the notices meet the minimum requirements of the DMCA and our other statutory obligations. It is up to the parties and their lawyers to evaluate the merit of their claims, bearing in mind that notices must be made under penalty of perjury.

    Repeat Infringers

    In accordance with the DMCA and other applicable law, Flightsim.to has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to our platform and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

    Please note: The DMCA requires that you swear to the facts in your copyright complaint under penalty of perjury. It is a federal crime to intentionally lie in a sworn declaration.
